I had a question about using using AC21.
Here is the scenario: Let us say I work for XYZ Company who applied for my 140 and 485. I have approved 140, H-1b, EAD and AP.
If XYZ laid me off or I left them for career progression or more money 180 days after my 485 was filed and 140 approved, what happens to my 485 application?
Wouldn't USCIS question that since my sponsoring employer does not exist anymore, who am I going to work for once I get my green card? or is this coverd under AC21?
Please advice!

However there are some unfortunate incidents going on where IO wrongfully denied 485 petitions when a person changed jobs using AC-21. I urge you to take part in IV AC-21 letters campaign which will help you and all of us to survive any unfortunate, unforseen job loss due to current downturn in economy. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?

No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

Just got 3 transfer notices from CSC saying applcations transfered to NSC. Applcations reached July23rd at NSC. 140 approved from TSC.
Anybody in similar situation....

Yes there is. You need to write to the Service Center that has your I-485 and ask that the approved I-140 with the earlier priority date be substituted for the one in your 485 file.

I'm at 485/EAD stage. not on H1b anymore. I recently badly sprained and fractured my ankle/foot. Am considering taking a leave for maybe two weeks from work.
Question: does going on short term disability and getting benefits from the state have any adverse effect on the immigration process?

If no websites, find the address from the State Governor's website and send a letter explaning the situation. they will send you a document-release form. Fill that form and send copies of all the required documents for your case.

I have not heard of a single approval date of someone applying on June 1st!
According to the processing dates, they are all in RD of 06 sometime.

Really appreciate the update paskal. I tried to look for this all over the internet but could not find it. So I posted it. I am not on J visa, however, many of my friends are.

I applied for my first EAD in May 2007 and had FP done in June 2007. I am now applying for my EAD renewal. Will there be another FP for the renewal?
This is really urgent as I am traveling to India in April for a month and I don't want to miss the FP appointment. Please let me know if you have info on this?

If you don't have photo copy then ask your lawyer, they always keeps copy of 485 documents before sending to USCIS. you should be able to get another one from India.

My baddest of the bad phases started recently when I lost my wife's birth certificate from India. Worst part is we dont have backup (no photo copies of it).
Anyways, We are waiting in the 485 queue, working on EADs. Question to all folks, do still need birth certificate now for the green card process, as we have already sent the application?
And how bad it is with redtape/corruption in India, to get another birth certificate from my wife's birth hospital, when we try by ourselves (I mean not involving our/her parents), when we visit India next time (maybe for a month)?

My lawyer checked my application type as
"h", and stating "Spouse has an approved I-140"
Since I am filing as dependent. Should it be "b" " my spouse or parent applied for adjustment..."

I was planning on just putting the documents(application and supporting docs) bound by paper clips.

Is it possible to have second H1b visa and Labor certificate approved for employer "B" while working on H1b visa and having Labor and I 140 approved for employer "A" ??

I-140 belongs to the employer only, so it is up-to them to disclose the details. Unless you change employer without using AC21 clause, I-140 details won't be necessary.
