    I live in GA. My 485 was filed at NSC and was receipted at CSC and transferred back to NSC.

    As per the filing instructions, I will have to file EAD at Texas Service Center.
    But some folks told me to file at the location where I-485 is pending.

    I have the following questions

    a> Where should I file my EAD renewal
    b> Is it true, paper based EAD renewal does not require finger printing

    Yes you don't need finger printing for paper based EAD renewal.

    Hi Almond and dilbert_Cal,
    I am in my seventh year of h1. I applied for one year extension.Not granted yet.
    So do I have to wait to get the extension approved ? Can I get my 140 approval and re-appy for 3 year extension and then make the move ?

    I am really grateful for that bit of info previously.

    Is the postal address same for EAD & AP renewal for e-Filers.

    The forms that printed out for EAD & AP renewal for e-Filers shows same address to send the supporting documents.

    And only EAD needs the 2 photos right not the AP for e-Filers.

    LOL..its good to have a sense of humor.

    I wish there was a way to know if a case is pre-adjudicated.

    This would help us to not file for H1 extensions, EAD, and AP. Which inturn would free up time for the officers to work on improving processing dates.

    Offcourse, i am still happy about the date movement.

    It just makes you wonder , if they USCIS was deligent in not wasting visas in previous years, even EB-3 would have had a reasonable date.

    Hello,
    The new fee structure goes into effect Aug 17.
    I vaguely remember reading an anecdote that there is no need to pay yearly renewal fees in the new fee structure. (Am I right?) Please share your views.
    Are there any advantages to filing per new fees?

    My husband has a pending I-130 visa petition (I am a US citizen, he's Italian, we live in Italy). Can anyone tell me whether he is permitted to enter (and exit, as we are still residents in Italy) the US on holiday (departure 19 dec)?
    I have not found any specific details in regard.

    My friends received Green cards in 2007. They live abroad, but make regular trips tho the Us to visit family and maintain their GC.

    Unfortunaltely, they recently misplaced their green cards. They are planning a trip to the US this month, for which they have received travel letters from the US Embassy abroad.

    Would anyone know what the process is afterwords? We know they have to file I-90s to replace their lost GC. Does this have to be done at the port of entry? Or is it done at a local office on reaching their final US destination?

    Also, will they be called for a biometric appointment locally or can that be done at a Port of Entry. Can the biometric be done at a location abroad?

    If anyone has any info on this, it'd be truly appreciated.

    Hello friends,

    I am on L1B and working in US for last 3 1/2 years. My L1 visa will expire in Jun 2011. In between another company is ready to sponsor H1B for me and it will file it in April 2010. So here are my questions.

    1. From when i can start working with new company on H1 ? From Jun 2010 (after getting H1 approval) or will have to wait till Oct 2010 ?

    2. What will be the duration of my new H1B visa, considering i already used 4 years of my L1 ? Is it 6 years or only 2 years ?

    I searched the forums briefly but could not find a similar case, please assist.

    There is a requirement for me to take up another position with the same employer (sort of Lateral job transfer) with the following details:

    My H1B is sponsored by State Government who I have been working for 6+ years.

    PD=DEC 2002, EB3
    485 Filed= JUNE 6, 2007
    FP = JULY 17, 2007

    The new position will be with:
    Same Employer
    Same Job Title
    Same Job Description
    Same Job Duties
    Same Pay
    Same Classification Code (internal state job code#)
    Same Supervisor
    Same Location physically same cabin
    Same everything else I can think of.

    ONLY THING DIFFERENT IS THE "POSITION NUMBER" that is assigned by the Personnel Department. There will be an internal advertising for the position and interview & selection process.

    I would like to know:

    1) Does accepting the position at this stage cause problem with the Green Card process, i.e, will it affect my I485, PD or anything else? I have waited 6+ years to get to this stage and obviously I do not want to take any kind of risk.

    2) Do I need to inform or check with USCIS or any other agency about this position change?

    3) Do I need to do anything else to protect my PD, AOS etc.


    I would appreciate all the assistance I can get.

    My wife is on H4 and she is studying Masters and we already have EAD. She would like to do Internship and she still has 6 months to graduation and my question is
    1) Is there any time restrictions for people to do internship (with GC based EAD)
    2) After graduation, can she still continue with her internship (using EAD ofcourse) ?
    3) If Yes for question 2, then for how long after graduation she can be an intern

    Apreciate if someone can give feedback on this.

    1) She can do internship with EAD there is no porblem and no time restriction .

    2) Yes she can continue ...

    3) As long as she has a valid EAD ..

    If the foreign financial institution (for example bank) are not reporting to IRS about our (US resident) bank account etc. Do we need to close our bank account in foreign country.

    My employer let me signed 3 contracts. First was for the year 2006 then two for 2007. They said they just changed a few things but it is the same. The previous two contracts said if ever employment is terminated prior to an agreed date, reimbursement to the employer will be pro-rated. The 3rd contract was changed to reimbursing the employer the full amount of the contract which means H1B fees, recruitment fees, sign-on bonus and reimbursement. I was not aware that they've changed the reimbursement because I did not read the third contract anymore because they said it's the same.

    Is it legal for the employer to charge the H1B employee the H1B fees, recruitment fee, sign-on bonus and reimbursements? I applied directly to my employer but they hired a recruiter and was just made aware of the huge amount after working for 3mos with them. They never gave me a copy of the total amount of my contract until I asked for it.

    They filed for my I-140. It was already approved and just waiting for the I-485 to be filed.

    Hi Everyone,

    For my I-140 (Premium Processing) USCIS's website is showing that they have sent a mail requesting more information on March 27th. Does anyone konw how long it takes to get to the lawyer's office? Para-legal at my lawyer's office told me that it takes about 14 days for that to reach them.

    At the same time she told me that they give 30 days (she was not sure) to respond.

    Can anyone please confirm this.
