came back to US on dec 30. Didnt get paid for the month of sept oct nov dec. But i was never out of status as I was in india. ... i have paystubs till aug 30 2009. never out of status
You actually were out of status since Dec 30 till this moment and you still are out of status. You are immediately out of status once you are not paid for the job or fired, regardless of the fact if employer revokes H-1 or not.
You can not do H-1 transfer any more. Your next H-1 petition will be a new petition but you will not be subject to H-1 cap as you already have been counted for 6 years.
So I presume it would safe to get a job offer and leave as soon as possible, then wait for the H-1 petition get approved, stamp H-1 visa and get back.

It looks like the rumors are no more circulating of people being deported.
There are no posts on the forum about it. So either there are no deportations now or people have realized that they were only rumors.
On Feb 16, I invited my neighbours on daughter's b'day and one of the lady was saying that one of her friend's was given only 20 days I-94 due to this new memo after so many argument because she has to wind up all her belonging here including her brand new car and her friend is leaving tommorrow that was on Feb. 17 ..I advised her to contact IV ..but was short of time ..don't know what happened later..never asked..

Quick survey to findout how many people like the idea of having their passports restamped here in USA and avoid all the surprises and shocks. This doesn't need any legal fixes. It is a convenient measure for everyone. Besides it was an old practice that was stopped for "security" reasons or some crapp. It is a small step but helps with any cases like family emergency or some urgent business need to travel abroad.

I've seen people getting the GC Approvals even though their PD is not current. But close to current published dates.
Good Luck to you and Keep your fingers crossed. Technically you are not in, but still you may be in. You never know with USCIS.

In september my dates became current and my GC and my spouse GC has been approved . However my lawyer recieved interview notices for me and my wife. What should be the next step. Ignore the notices as we recieved the Green card or do we need to attend the interview.

My wife got a job offer on contract basis for 3 months. I am on h1 and she is on h4 so far. I am planning to stay on h1 itself. If my wife accepts this job using EAD, Does my status also changes? Is it okay if she dont find a job after this contract expires, what status she will be in during that time, h4 or EAD?
Please advice, Thanks a lot ....
No..your status will not change. You can still maintain your H1. She can go on EAD and work for 3 months and she will be in AOS status if she does not find any job. She will not go out of status. She can work 40hrs, 20hrs or 0hrs..it will not affect her status.

You just need to fill up the first page & the rest 3 pages would be automatically filled. That's how we did, you can still check against this.

All this inventory etc dosent make sense ,
Pending EB2 cases for china are around 2000 as per USCIS inventory .
but as per DOS Demand data its only 500 ..

Wondering if a little something when filing my taxes will backfire on me when filing I-140/485.
I'm single/no dependents but for past 4 yrs or so when filing taxes have showed 2 dependents for child tax credit (no earned income credit applied for)....my niece/nephew. My bro had full knowledge and he had suggested as due to his status in US, he is not required to file taxes. Sis in law not working, so not filing taxes. So i used to do that....
It won't come to bite me right???? ok i am never doing this from now on but is it too late for me. Obviously on my immigation forms i will show no dependents etc as i have none...
any advice.....
Personally, I wouldn't send my tax returns until I have spoken to a GOOD lawyer. There are quite a few IO that do not ask for tax returns b4 or during the interview. However, it shouldn't be a problem as you can explain it away. Simply - they were my dependents in those 4 years !! But now they are not, simple.

Sorry cant help you on the documentation piece.
But since your I-140 is filed, you should upgrade it to PREMIUM and try to get it approved asap.
Worst case scenario - if company B is not considered successor in interest to company A, you can still use the approved I-140 to carry over your PD.
